The Right to Remain Silent

You’ve probably also heard about the “right to remain silent, and that anything you say may be used against you in court.”  For this reason, you should not discuss your case with anyone other than your attorneys, as those with whom you discuss your case might be called at trial to be a witness against you.

If You Have Been Charged with a Crime, or if you Believe that you May Be Charged with a Crime, You Need a Lawyer

The police are very good at trying to get those charged with a crime to “open up” and discuss the crime.  They may try to minimize the crime in question, or lead a person to believe that they can help the person out if they fully cooperate.  They may even try to make the person believe that if they are innocent, there is no need to have a lawyer.

The police do not have to be honest in their questioning. Their job is not to represent the rights of the accused – this is our job.

Even if you want to help out in an investigation because you know you are innocent, it’s still a good idea to retain an attorney, who can then work on your behalf and ensure that your rights are protected.

It’s critical that you obtain a lawyer as soon as possible.  In some cases, such as with an OWI charge, there are actions that must be taken within very short time periods (such as the right to challenge a refusal or administrative suspension of your driver’s license, which must be taken within ten days following an arrest for OWI). Often persons charged with OWI do not notice those documents in the pile of papers they get when they leave the police station.
